LOOTE LTD, with its registered office in Arachovas, 3, 3096, Limassol, Cyprus, Company Number: HE 452854, (hereinafter referred to as ”
LOOTE LTD”) to establish a contract with
persons (hereinafter referred to as “
Users”) who use the website at https://proxysio.com/ (hereinafter referred to as the “
Website”). Hereinafter parties of the contract are referred to as the “
Parties” and separately as the “
Party”)
If the User does not agree with terms and conditions of this Offer, he cannot use the Website. By registering, making a rent/purchase on the Website, the User accepts the terms and conditions of this Offer and unconditionally agrees with its conditions.
The User is also responsible for ensuring that anyone who accesses the Website through his internet connection is aware of these Offer and comply with them.
- SUBJECT OF THE OFFER
- 1.1. LOOTE LTD gives the User the right to use the Website. Use of Website is the use of the Proxy Service, i.e. the renting of an intermediary server.
- 1.2. The right to use the Website is granted to Users by LOOTE LTD in accordance with the Price List posted on the Website.
- 1.3. LOOTE LTD reserves the right to use both its own and partner Proxies to fulfil its obligations under this Offer.
- RIGHTS AND OBLIGATIONS OF THE PARTIES
- 2.1. Terms of rent. The User is obliged to:
- 2.1.1. Fix all client-side DNS leaks when working with a proxy, WebRTC, language mismatch between IP address and system/browser, time zone mismatch between IP address and system/browser, real GPS coordinates that do not match IP address geolocation, etc. browserleaks.com services are recommended for checking client leaks.
- 2.1.2. When multi-accounting (working with two or more accounts and / or registering two or more accounts on services on one device), use the unification of browser fingerprints and device identification parameters - use new hardware for each new account (PC, laptop, phone, tablet etc.) or recommended antidetect browsers with browser fingerprint substitution ( MultiLogin, LinkenSphere etc.).
- 2.1.3. Do not engage
- 2.1.3.1. Scamming, checking logs, phishing, cashing out, carding and checking balances in payment systems and bank accounts;
- 2.1.3.2. Scanning by port, searching for vulnerabilities on websites, brute force (brute-force attack);
- 2.1.3.3. Spam and e-mailing (mail ports closed anyway);
- 2.1.3.4. Fraud, slander, deceit, threats, insults, and distribution of malware;
- 2.1.3.5. Violation of the laws of the country in which the proxy server is located;
- 2.1.3.6. Mass registration on static proxies (does not apply to mobile proxies);
- 2.1.3.7. Partially or completely bypassing various blockings and restrictions on the part of organizations providing Internet access services and other Internet-related services (or Internet providers).
- 2.1.4. Timely notify the technical support of the service about problems in the work of the proxy.
- 2.1.5. When contacting technical support, indicate the number (ID) of the order/orders from personal account.
- 2.2. The User agrees that:
- 2.2.1. The service is a proxy server, so the service does not provide support for access to specific sites, nor does it guarantee the availability of these specific sites. The service guarantees only the performance of the provided proxy servers, which can be checked by going to sites that do not block access for individual locations and IP addresses (for example, httpbin.org). At the same time, the sites themselves should not experience any technical problems with their performance at the time of the check (such as domain unavailability, interruptions in access from some locations, etc.). Lack of access to a resource that applies access restrictions for certain countries, providers, subnets and IP addresses is not a violation by the service of the terms of provision of the proxy server rental service and is not an objective and valid reason for replacing, returning or compensating for the proxy server expiration date.
- 2.2.2. Some services for checking geolocation (especially whoer.net and built-in geolocation determiners in software) may incorrectly indicate the region to which the proxy belongs. Why this happens is described in the article "Incorrect geolocation detection on IP address". The same applies to third-party proxy checkers, which may erroneously indicate that the proxies are not working. Refunds due to a problem on the part of the services in this case are not provided, the possibility of replacement is discussed on an individual basis by contacting the user with technical support, the methods of contact with which are regulated by clause 2.2. sub clause 6.
- 2.2.3. Some services may erroneously indicate that a proxy or VPN is being used if the service uses IP address type detection, which is not a direct indication that a proxy is being used. In this case, if there is no direct evidence of leaks on our proxies (open ports, headers, "leakage" of the real IP) - replacement or refund is not possible for this reason.
- 2.2.4. IP address matching to obtain any (low, medium, or high) of the "IP Address Quality Scores" (Fraud Score, Risk Score, etc.) is not provided. Refunds due to non-matching are not available.
- 2.2.5. Some resources may be blocked in some plans or countries. Basically, these are payment systems, bank sites and sites where unauthorized use of proxies leads to a deterioration in the quality of the latter or blocking (bet365, Avito, Pinnacle). Opening access is possible, but not always, and is negotiated on an individual basis by contacting the user with technical support, the methods of contact with which are regulated by clause 2.2. sub clause 6.
- 2.2.5.1. Open access to blocked resources is not provided for orders for shared proxies.
- 2.2.5.2. The service can unilaterally stop access to any of the blocked resources, access to which was previously granted.
- 2.2.5.3. The list of blocked resources is updated periodically, but only those resources get there, the use of proxies on which, theoretically, if used illegitimately, can violate the rules for using our service.
- 2.2.5.4. Refunds due to the reason that access to a blocked resource is not available or access to a blocked resource is denied.
- 2.2.6. User support is provided via email (ADMIN@PROXYSIO.COM) with an average response time of up to 5 minutes (in fact, 30-40 seconds), but individual requests can be processed longer (up to 24-48 hours). Also, the administration, as well as the support, has the right to ignore requests that it considers incorrect (not related to the service, with obscene expressions, etc.), as well as block access to the online chat due to incorrect requests from the user.
- 2.2.7. The service administration reserves the right to unilaterally disable the user from using the service without a refund in case of violation of at least one of the user's obligations (clause 2.1.4, sub clause 1 — 7).
- 2.2.8. Proxies are issued automatically, but after confirmation of the fact of payment by the processing center (payment aggregators and systems), which the service cannot affect.
- 2.2.9. The service has the following refund policy:
- 2.2.9.1. Refunds are made only for orders. There is no refund from the balance of the personal account, since by replenishing the balance you purchase the currency of the service for further purchases within the service, and do not start an electronic wallet for depositing and withdrawing funds.
- 2.2.9.2. Refund of funds for the order is possible only for an objective reason and within 24 hours from the date of payment of the order, however, the service administration, as well as support, reserves the right to refuse a refund if the user provides incorrect reasons for the refund or in case of violation by the user of at least one of the points of the user's obligations (clause 2.1.4, sub clause 1 — 7). Also, in some cases, the period during which you can request a refund depends on the reason for the refund or the tariff and is regulated by other clauses of this Offer.
- 2.2.9.3. One one-time refund is possible only for orders up to $6, and one can request a refund only once and for one banking details. After making a refund, the service administration reserves the right to disable the user from using the service or restrict the user's rights to a refund in the future.
- 2.2.9.4. Refunds are not provided for orders for shared proxies (tariffs with the occurrence of the word "Shared"), since the user assumes all risks for inactivity, unavailability of individual resources, blocking and interruptions when working with proxy data.
- 2.2.9.4.1. Refunds are only possible to the following payment systems: USDT and Visa/MasterCard. The possibility of a refund to other payment systems and cards is discussed, but it is not guaranteed, and the commission in this case is paid by the user.
- 2.2.9.4.2. The refund is made within two business days, but in some cases this time may be extended.
- 2.2.10. The following proxy replacement policy applies to the service:
- 2.2.10.1. Proxy replacement is possible only for an objective reason and within 24 hours from the moment of ordering, however, the service administration, as well as support, reserves the right to refuse replacement if the user provides incorrect reasons for replacement or in case of violation by the user of at least one of the points of the user's obligations (clause 2.1.4, sub clause 1 — 7). Also, in some cases, the period during which you can request a proxy replacement depends on the reason for replacement or the tariff and is regulated by other clauses of the Offer.
- 2.2.10.2. Replacement due to the need to issue different or specific subnets to the order is possible only within an hour after purchase, and also the user, if necessary, to replace the proxy for this reason, before buying, undertakes to specify the number of different and specific subnets that can be issued in one order for a specific country of a specific tariff, by contacting the technical support of the service, the methods of contact with which are regulated by clause 2.4.
- 2.2.10.3. Replacement due to the need to issue different or specific cities to the order is possible only within an hour after purchase, and also the user, if necessary, to replace the proxy for this reason, before buying, undertakes to clarify the availability of cities that can be issued in one order for a specific country of a specific tariff, by contacting the technical support of the service, the methods of contact with which are regulated by clause 2.4.
- 2.2.10.4. Proxy replacement is not provided for orders for shared proxies (tariffs with the occurrence of the word "Shared"), since the user assumes all risks for inactivity, unavailability of individual resources, blocking and interruptions when working with proxy data.
- 2.3. LOOTE LTD provides the access to the Site to unlimited number of Users.
- 2.4. LOOTE LTD reserves the right to change this Offer without notifying users, but the Offer will always indicate the date of its update. The User is obliged to regularly monitor any changes made to the Offer. In case the User does not agree with the new version of the Offer, the User must immediately stop using the Website.
- 2.5. LOOTE LTD reserves the right to update the Website. The updated Website may contain corrections of errors,, fixed bugs, other updates.
- 2.6. The personal information is collected with the consent of the User and in accordance with the Website Privacy Policy. The provision by the User of any personal data means their consent to their processing by LOOTE LTD in order to perform the Offer.
- INTELLECTUAL PROPERTY RIGHTS
- 3.1. The Website and all related intellectual property rights objects, including the texts, drawings, images, databases, audio and video materials contained on the Website are the property of LOOTE LTD.
- 3.2. The User is not allowed to reproduce, repeat, copy, sell, use in commercial purposes materials or content of the Website.
- RESPONSIBILITY
- 4.1. LOOTE LTD is not responsible for the failure to provide (poor-quality. provision) services for any reasons that are beyond the competences of LOOTE LTD.
- 4.2. LOOTE LTD is not responsible for the compatibility of the Website with User’s devices, from which the User operates with the Website.
- 4.3. LOOTE LTD is not responsible for the suitability of the LOOTE LTD Website for the intended purposes of the User.
- 4.4.LOOTE LTD is not responsible for the actions of the User with the Internet Service or its instruments.
- 4.5. LOOTE LTD is not responsible for any unlawful actions of partners in fulfilling clause 1.5 of this Offer.
- 4.6. The User is responsible for any violation of the terms of this Offer.
- 4.7. The User himself provides security of login and password and is responsible for all actions taken by him after Registration.
- 4.8. Parties are not responsible for the failure to fulfil their obligations caused by force majeure.
- OTHER CONDITIONS
- 5.1. LOOTE LTD service is provided “as is” without warranty of quality or fitness for use, express or implied. LOOTE LTD does not guarantee that the information uploaded by the User meets its standards of truthfulness, accuracy, or relevance.
- 5.2. LOOTE LTD has the right to send to the User messages relating to LOOTE LTD, the Website, the Offer, and the services provided via the Website interface and/or by email.
- 5.3. With regard to the use of the Website, Parties apply the laws, the procedural laws of Great Britain.
- 5.4. The Parties consider the proper signing of documents (and attachments) sent by email (and also by exchanging scanned copies by e-mail) as well as documents sent through the account on the Website. Such documents have full legal force.
- The proper email addresses are: for LOOTE LTD – the email addresses given on the Website; for the User – the email address given by them when registering on the Website.
